1. 1. following your visits to this site, the compilation of forms, the receipt of your requests/questions, preliminary contacts, surveys and market research, any establishment of business relationships, our company will collect and process your personal data
   2. we specify from now on for clarity, the following definitions given by the European Regulation 2016/679:

Personal Data: any information concerning an identified or identifiable natural person (“data subject”); an identifiable person is one who can be identified, directly or indirectly, by reference in particular to an identifier such as a name, an identification number, location data, an online identifier or to one or more features of his or her physical, physiological, genetic, mental, economic, cultural or social identity;

Processing: any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, restriction, erasure or destruction.

All of the above, pursuant to article 13 of the European Regulation 2016/679,

we inform you that the collection and processing of personal data will be carried out by the undersigned company in accordance with the following:

general purposes: your data will be processed to satisfy your requests/questions, for the correct carrying out of bureaucratic, accounting, fiscal, commercial, technical fulfilments and for the company activities that are compulsory by law and in any case strictly inherent to the existing relationship.

“Direct marketing”: your data can be used, only and exclusively after your free, optional, specific and explicit consent revocable at any time, even for sending material / advertising communications by mail, e-mail, telephone, fax, sms, mms and similar tools; after having given your consent, it is still your right to oppose, at any time and without charge, the processing of your data for this purpose;

purpose of “profiling”: the data (not sensitive/particular) resulting from the compilation of our form(s)/sheets, can be used, only and exclusively after its free, optional, specific and explicit consent revocable at any time, to identify and define the tastes, preferences, habits, needs and consumption choices of his person (so called “profiling”). After expressing your consent, you have the right to object, at any time and without charge, to the processing of your data for this purpose.

modality: the data will be treated both with paper and electronic/computer/telematic instruments/supports, in full respect of the law, according to principles of lawfulness and correctness and in such a way as to protect your privacy;

optional conferment: the conferment of your data is optional and not mandatory;
consequences of a possible refusal: the refusal to provide the data or the complete opposition to their treatment for the purposes referred to in paragraph a), may however result in the impossibility to satisfy some of your requests; the refusal to use the data for the purposes referred to in points b) and c), will not have any consequences on the business relationship or on the recognition of benefits related to promotions;
subjects or categories of subjects (recipients) to whom the data may be communicated or disseminated: the data may be communicated to third parties only to fulfill legal obligations or contractual nature. The data will not be disclosed in any case;
persons authorized to process: the data will be processed only by a small number of employees of the administrative, marketing, CED and commercial, specially authorized;

automated decision-making processes: automated decision-making processes are not managed in any way; regarding “profiling”, please refer to point c) above;

rights of the data subject: you enjoy all the rights enshrined in the European Regulation 2016/679, such as the right to request access to personal data and their rectification, erasure, restriction of processing, the right to object to their processing, as well as the right to data portability. It also has the right to lodge a complaint with the Control Authority;

transfers to third countries: any transfer of personal data to a third country outside the European Union or to an international organization will take place on the basis of an adequacy decision by the Commission or, in the case of transfers referred to in Articles 46, 47 or 49, second paragraph, of the European Regulation, on the basis of appropriate and adequate safeguards;

date of data retention: the data will be kept for the period of time strictly necessary to meet the requests of the interested party or according to what is provided for by the regulations in force or by any contractual clause; in particular, the data processed for the purposes referred to in point c) will be kept for a period of 12 months;

the data controller: the data controller is the undersigned company LAGRUA di Simona Rocchi, Via le Botteghe 54 – 80073 Capri (NA), in the person of its pro tempore legal representative Mrs. Simona Rocchi.

This information notice may be integrated, either orally or in writing, with further elements and indications, in order to better satisfy any need to know about “Privacy” and to comply with the evolution of the law.
